Introduction

Dr Diu SkinVet Specialist LLP (“The SkinVet“, “us”, “we”, or “our”), a limited liability partnership having its registered office at 13, 5th Floor, Shreeniketan, 86-A Netaji Subhash Road, Marine Drive, Mumbai – 400 002, and operating its veterinary dermatology specialist clinic at Shop 8, Ground Floor, Shubhada Towers, Upper Sir Pochkanwala Road, Worli, Mumbai – 400030, owns and operates the website www.theskinvetco.in (the “Website“), through which we share information about, and allow you to request, our veterinary dermatology consultation and related services (together with the Website, the “Services“).

Please read these Terms and Conditions (“Terms“) carefully. They govern your access to and use of the Website, and your use of any content, forms, booking functionality, or payment facility made available through it.

We reserve the right, at our sole discretion, to change, modify, add to, or remove portions of these Terms at any time. We will notify you of any material change at least once a year, or whenever a change is made, by posting an updated version on the Website with a revised “Effective Date”. Continued use of the Website after such changes constitutes your acceptance of the revised Terms. Please also read our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree with these Terms, please do not use the Website. You may not use the Website if you are not lawfully entitled to do so, or if you are not of legal age (18 years or above) to enter into a binding contract under Indian law. If you are submitting a booking request on behalf of a pet whose owner is a minor or a person otherwise unable to contract, you confirm that you are their parent, legal guardian, or are otherwise authorised to act for them.

1. Acceptance of Terms

You will be deemed to have accepted these Terms when you:

(a) access or browse the Website;
(b) submit any form on the Website, including the “Book a Consultation” form; or
(c) otherwise use any Service offered through the Website. Your continued use of the Website after any update to these Terms will be treated as your continued acceptance of the Terms as updated.

2. Information You Provide

The Website allows you to submit information through our “Book a Consultation” form and other contact forms, including your name, phone number, your pet’s name, your preferred mode/time of consultation, and any message or concern you wish to share with us.

You agree that:

(a) all information you provide to us is true, accurate, current, and complete;
(b) you will only submit a booking request for yourself, or for a pet you own or are authorised to bring in for treatment; and
(c) you will not submit a booking request using another person’s name, phone number, or contact details without their knowledge and consent.

If we have reasonable grounds to believe that any information provided is false, inaccurate, or incomplete, we may decline to confirm or honour a booking request, at our sole discretion.

3. Use of the Website

You agree that you will not use the Website to host, display, upload, modify, publish, transmit, or share any content that:

(a) belongs to another person and to which you have no right;
(b) is harmful, harassing, defamatory, obscene, hateful, or discriminatory in nature, or otherwise unlawful;
(c) is false or misleading;
(d) infringes the intellectual property, privacy, or other rights of any third party;
(e) contains viruses, malware, or other code intended to damage or disrupt the Website or its users;
(f) attempts to gain unauthorised access to the Website, our systems, or the data of other users;
(g) impersonates any person or entity, or misrepresents your affiliation with any person or entity; or
(h) otherwise violates any applicable law.

We reserve the right, but not the obligation, to monitor use of the Website to ensure compliance with these Terms, and to remove any content or restrict access to any person who, in our sole discretion, violates these Terms.

4. Online Consultation Booking and Payments

(a) Booking Requests. When you submit the “Book a Consultation” form on the Website, you are sending us a request to book a veterinary consultation. A booking is only confirmed once you have completed payment of the applicable booking/confirmation deposit (below) and received confirmation from us of your appointment slot.

(b) Booking/Confirmation Deposit. To confirm an appointment slot booked through the Website, you will be directed to a secure third-party payment gateway to pay a refundable booking/confirmation deposit (“Booking Deposit“). The Booking Deposit secures your appointment slot and will be adjusted against your final consultation/treatment fee, payable at the clinic at the time of your visit. The balance of all consultation, diagnostic, medication, and other charges is payable directly at the clinic, as set out in Section 6 (Settlement Terms) below; we do not currently process these balance payments online. For online consultations, the consultation fee in its entirety will be collected in advance.

(c) Third-Party Payment Gateway. All online payments are processed through an independent, RBI-authorised third-party payment gateway. We do not store, and do not have access to, your full card, UPI, or net-banking credentials; these are collected and processed solely by the payment gateway in accordance with its own security standards and privacy policy. We are not responsible for, and shall not be liable for:
(i) any failure, delay, or error in authorisation of a transaction;
(ii) any limit imposed by your bank or payment provider; or
(iii) any other issue arising from the payment gateway’s systems that is beyond our reasonable control. All payments must be made in Indian Rupees (INR).

(d) Refund and Cancellation. Please see Section 7 (Refund and Cancellation Policy) below for the terms applicable to your Booking Deposit.

5. Fees

Fees for consultations, diagnostics, medications, and other treatments are charged at our current rates, depending on the nature of the consultation and the materials, medications, and consumables used. Our fee schedule is available on request, and an itemised invoice is provided for every consultation, procedure, or transaction.

6. Estimates of Treatment Cost

On request, we will be happy to provide an estimate of the probable cost of your pet’s treatment. Please note that any such estimate is approximate only, as a pet’s dermatological condition and response to treatment may not always follow an expected or conventional course.

7. Refund and Cancellation Policy

This Section applies specifically to the Booking Deposit paid online through the Website to confirm a consultation appointment.

(a) Cancellation by You. If you cancel or request to reschedule your appointment at least 24 hours before your scheduled appointment time, your Booking Deposit will be refunded in full to your original mode of payment. Refund requests can be made by writing to care.worli@theskinvetco.in or calling +91 98192 04621.

(b) Late Cancellation / No-Show. If you cancel, reschedule, or fail to show up for your appointment with less than 24 hours’ notice, the Booking Deposit will not be refunded.

(c) Cancellation by Us. If we need to cancel or reschedule your appointment (for example, due to a treating veterinarian’s unavailability or an emergency), we will offer you the choice of a full refund of the Booking Deposit, or rebooking at the next available slot at no additional cost.

(d) Refund Timelines. Approved refunds will be processed to your original payment method within 7–10 business days, depending on your bank’s or payment provider’s own processing timelines, which are outside our control.

(e) Charges Paid at the Clinic. Once any consultation, diagnostic, or treatment charge is paid directly at the clinic (in cash, by card, or via UPI), it is non-refundable, except where required by applicable law, since these relate to professional services and consumables already rendered or used.

(f) We shall not be liable for any loss arising from: (i) lack of authorisation for any transaction; (ii) any pre-set transaction limit between you and your bank; (iii) any other payment-processing issue; or (iv) rejection of a transaction for any reason, in each case to the extent caused by the payment gateway or your bank and beyond our reasonable control.

8. Settlement Terms

All consultation fees, diagnostic charges, medication, and product charges (other than the Booking Deposit) are payable in full at the clinic before your pet leaves following a visit. For online consultations, the consultation fee in its entirety will be collected in advance. The SkinVet follows a “no-credit” policy. Overdue accounts may attract additional charges and may be referred to legal counsel for recovery. Any card payment found to be invalid or unauthorised, will result in the underlying balance being treated as outstanding, together with any costs reasonably incurred by us in recovering it.

9. Complaints and Redressal

We hope our service never gives you cause for complaint, but if it does, please speak with our clinic manager at the Worli clinic in the first instance. Where possible, we will resolve your complaint immediately; otherwise, we will acknowledge it and aim to revert to you within 7–10 days.

10. Content and Intellectual Property

All content on the Website, including text, graphics, logos, images, and software (excluding any content you submit to us, such as messages through our forms), is owned by us or our licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may view and download content from the Website only for your own personal, non-commercial use, and you may not modify, reproduce, distribute, or create derivative works from it without our prior written consent.

You agree not to:

(a) reverse-engineer, decompile, or attempt to extract the source code of the Website;
(b) remove any copyright, trademark, or other proprietary notice from the Website; or
(c) use the Website for any commercial purpose other than booking a consultation with us.

11. Termination of Access

We may, at our sole discretion, restrict or terminate your access to the Website or any Service, including for violation of these Terms, suspected fraudulent or false information, or misuse of the Website, with or without prior notice, subject to applicable law.

12. Disclaimer and Limitation of Liability

THE WEBSITE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

ANY GENERAL INFORMATION, ARTICLES, OR EDUCATIONAL CONTENT PUBLISHED ON THE WEBSITE IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT FOR YOUR INDIVIDUAL PET. NO VETERINARIAN-CLIENT-PATIENT RELATIONSHIP IS CREATED BY YOUR USE OF THE WEBSITE OR SUBMISSION OF A BOOKING FORM; SUCH A RELATIONSHIP COMMENCES ONLY UPON AN ACTUAL EXAMINATION OF YOUR PET BY ONE OF OUR VETERINARIANS AT THE CLINIC. ALWAYS SEEK A FORMAL CONSULTATION, AND IN AN EMERGENCY CONTACT A VETERINARIAN OR EMERGENCY ANIMAL HOSPITAL DIRECTLY, RATHER THAN RELYING ON WEBSITE CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, INCLUDING ANY ERROR, INTERRUPTION, OR UNAUTHORISED ACCESS TO OUR SYSTEMS, OR ANY ISSUE ARISING FROM THE THIRD-PARTY PAYMENT GATEWAY. NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR THE PROFESSIONAL VETERINARY SERVICES ACTUALLY RENDERED TO YOUR PET AT OUR CLINIC, WHICH ARE GOVERNED SEPARATELY BY THE TERMS OF YOUR CONSULTATION/TREATMENT AND APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless The SkinVet, its partners, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, or your violation of any applicable law or third-party right, in connection with your use of the Website.

14. CCTV and Security

For the safety of patients, clients, and staff, and for the prevention and detection of any wrongdoing, CCTV cameras are in operation at our Worli clinic. Footage recorded is our property and will not be shared with any third party, except where required by a written request from a government or law enforcement authority, in accordance with applicable law.

15. Ownership of Records

We follow good record-keeping practices in maintaining your pet’s clinical records, including consultation notes, cytology results, and treatment history. Where relevant, we may request copies of your pet’s past medical records from other clinics to ensure continuity of care. If you wish to access your pet’s medical history, please email us at care.worli@theskinvetco.in or speak with our front-desk team.

16. Third-Party Links and Services

The Website may link to third-party websites or services (including our payment gateway and social media pages). We do not control, and are not responsible for, the content, privacy practices, or terms of such third parties. We encourage you to review their respective terms and privacy policies before using them.

17. Variation of Terms

No addition or variation to these Terms shall bind The SkinVet unless made in writing and signed by an authorised partner of Dr Diu SkinVet Specialist LLP. No employee or agent has authority to vary these Terms on our behalf.

18. Feedback

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms, in whole or in part, at our discretion.

20. Severability and Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website, and supersede any prior understanding on the subject. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.

21. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, subject to applicable law.
